USCIS requires all adults and children petitioning for Adjustment of Status to file an I-765 form. With approval, the applicant can obtain a Social Security card good for driver’s license, identification or work prior to receiving the Green Card. Employment Authorization should be approved within 90 days from the day of filing with USCIS. This USCIS filing fee is included in the Adjustment of Status filing fee if filed concurrently.

If your Spouse/Child wants to travel in and out of the United States prior to receiving the Green Card, a form I-131 Advanced Parole must be filed. It is for specific travel dates only. The I-131 Advanced Parole should be approved within 120 days from the date of filing.

This USCIS filing fee for Advanced Parole is included in the Adjustment of Status filing fee.

• USCIS Filing – K1 Petition Package will be Fed Ex'd or Express Mailed to the USCIS.
• Notice of Action 1 – Within 30 days from filing you will receive Notices of Action for the Adjustment of Status, Employment Authorization and Advance Parole (temporary travel, if applied for).
• Notice of Action 2 – Within 60 days the applicant will receive an appointment for biometrics (fingerprints) at a USCIS location near you for the Employment Authorization card.
• Notice of Actin 3 – Within 30/60 days from biometrics the applicant will receive the Employment Authorization Card (EAC). With this card he/she can obtain her permanent social security card and accept employment legally. Recently USCIS has issued the EAC as a Combo Card valid for Employment and Advance Parole (temporary travel outside the USA). If so, the card will have printed at the bottom “Serves as Advance Parole.”
• AOS Granted – Within 8 to 10 months the applicant will receive a Notice of Action for the interview with USCIS for Green Card approval. Both the applicant and spouse need to attend. The card will be mailed shortly thereafter and will be valid for 2 years. You will have to remove the conditional status within the 90 days before expiration by filing form I-751 with supporting documentation and USCIS fees. In some cases USCIS has waived the requirement of the interview. If this is so for you, they will notify you in writing and your Green card will be mailed to you.

Cherry Blossoms has been helping immigrants who entered the US as K1 Fiancée or K2 Child Visa since 1980. Over the years the time from start to finish has changed but in most cases, we are seeing the approval rates between 8 and 10 months from the time you apply. There are some things which can affect the start to finish:

• How many applications are at the USCIS.
• The #1 is an applications without any errors. (We do it right the first time!)
• Most member's who do their own petition make simple little mistakes and usually several of them, and each mistake will add on about 1 month to the process. The average petitioner will make about 5 or 6 small errors, and that's adding on about 6 to 9 months.
